Against Claims of False Imprisonment
The concept of "false imprisonment" is usually associated with
a criminal act relating to abduction or kidnapping. However, this web
tip relates to false imprisonment as a civil suit. The definition varies
somewhat state by state, but the civil claim of false imprisonment generally

Evidence Meets Reliability Criteria
On May 13, 1999, the United States Court of Appeals for the Eleventh Circuit
held that the district court properly admitted handwriting identification
evidence as satisfying the "scientifically reliable" criteria
of the Daubert case in United States v. Paul,....175 F.3d 90.6 (11th Cir.
1999). At the same time, the reviewing court held that the trial court
properly excluded a law professor's testimony criticizing the reliability
of handwriting identification evidence because he lacked the skill, experience,
training, or education in the field.

Scent Evidence...Is it Scientific?
Ten years ago Taslitz (1990), in his comprehensive study on dog scent
lineups, expressed a view that the uniqueness and stability of human odour
had not been established yet and experimental research in the area of
dog scent identification still was in its infancy, therefore scent lineups
should be excluded from evidence in court. A decade in forensic science
is more than a century in law, however, so it seems worthwhile to look
at the possibilities of canine human scent identification again.

Role of Criminal Profiling in the Development of Trial Strategy
In 1972, the FBI's newly formed Behavioral Science Unit developed and
propagated some of the earliest psychological profiling techniques and
training, which were first taught to students at the FBI National Academy
by SA Howard Teten and SA Pat Mullany. They espoused the idea that constructing
a criminal profile from the physical evidence in an unsolved case could
effectively aid in the process of suspect development, and investigative
strategy. The past three decades have been a continual exercise in demonstrating
that they were right.

man or woman is suffering from depression and seeks therapy. The concerned
therapist, hyper-enlightened about the high incidence of sexual abuse
against children, immediately (almost telepathically) suspects that the
patient's depression is a symptom of post-traumatic stress disorder arising
from repressed memories of childhood sexual abuse. The therapist learns
that the patient has recurring nightmares involving a shadowy, unidentifiable,
vaguely threatening figure. The therapist believes these nightmares are
the key to the patient's repressed memories, and assists the patient in
unlocking the images of the dream.
